**1. Introduction**
This document governs the general terms and conditions of sale of the products offered on the website www.cinefive.it owned by CINEFIVE SRL , with registered office in Via Roberto Tremelloni 15, 20128 Milan (MI), VAT number 14011770964 , e-mail info@cinefive.it . By making a purchase on our website, the customer fully accepts the following terms and conditions.

**2. Object of the contract**
This contract has as its object the sale of goods through the e-commerce site www.cinefive.it . The customer undertakes to carefully read and accept these terms before placing an order.

**3. Purchase Method**
• The customer can select the desired products and add them to the cart. Before confirming the order, a summary will be displayed with the total price and purchase details.
• The order will be considered binding only after confirmation via email by the seller.
• The seller reserves the right to cancel an order in case of product unavailability or for technical reasons.

**4. Prices and payments**
• All prices indicated on the site are expressed in EURO (€) and include applicable taxes, unless otherwise indicated.

• In case of payment by credit card or electronic methods, the customer guarantees that he is the owner of the means of payment used.

**5. Shipping and deliveries**
- Products are shipped to the address provided by the customer when ordering.
- Delivery times vary based on destination and product availability. Typically, shipping occurs within 9 working days.

**6. Right of withdrawal**
- In accordance with Directive 2011/83/EU, the customer has the right to withdraw from the purchase within 14 calendar days of receiving the product, without having to provide reasons.
- To exercise the right of withdrawal, the customer must send a written communication to the email address support@cinefive.it and return the product intact and in the original packaging.
- Return costs are the responsibility of the customer, unless otherwise indicated by the seller.
- The refund will be made within 14 days of receiving the return, after checking the condition of the product, using the same payment method chosen by the customer at the time of purchase, unless otherwise indicated.

**7. Warranty and defects of conformity**
- In compliance with the Consumer Code (Legislative Decree 206/2005, art. 128-135) , the products are covered by a legal guarantee of conformity for a period of 24 months from the date of delivery.
- The seller is responsible for defects of conformity that appear within two years of delivery.
- The customer must report the defect within 2 months of its discovery.
- If the defect appears within 12 months , it is presumed that it was already present at the time of purchase, unless proven otherwise.
- The customer has the right to free repair or replacement , or, if impossible or too expensive, to a price reduction or refund .
- The legal guarantee of conformity does not apply to products customized at the customer's request, to used or regenerated products, unless otherwise indicated in the product sheet.

**8. Limitation of Liability**
- The seller is not responsible for damages resulting from improper use of the purchased products.
- In no event shall the seller be liable for indirect, consequential damages or any economic losses arising from the use of the products. The total liability of the seller shall not exceed the total value of the order placed by the customer

**9. Changes to the Terms and Conditions**
The seller reserves the right to modify these Terms and Conditions at any time. The modifications will be effective from the date of publication on the site.

**10. Applicable law and competent court**

This contract is governed by Italian law.

Pursuant to art. 66-bis of the Consumer Code , for disputes arising from relationships with consumers, the court of the place of residence or domicile of the consumer will have jurisdiction.

For all other disputes, the Court of Milan shall have exclusive jurisdiction.
